Law 2008-789 of 20 August 2008 on reforms concerning employee representation and the reform on working hours will come into force on 1 January 2009. This change in government policy is associated with the change in the sociological make-up of the work-force and may have a dramatic impact on your company if you do not take appropriate action beforehand.

What are the main reforms? The nature of employee representation is amended: a trade union must obtain at least 10% of the votes cast to be recognised. A company labour agreement will only be deemed valid provided it is approved by trade unions or equivalent bodies receiving at least 30% of the votes. A new trade union may appoint delegates to the works council once it has been in existence for at least two years. A new position has been created, that of Trade Union Section Representative. Employees in priority companies have the choice of voting in the user company or in the service provider .

The new conditions introduced by this law may offer your company interesting opportunities. And the next employee-representative elections will be decisive as the new rules governing representation will apply from the first round of every election to the Works Council.
